As criminal defense attorneys we constantly hear individuals complain about an old criminal conviction that has been a nuisance in their life ever since. Many of our clients are well respected members of the community but have been held back by a pesky criminal conviction from years earlier when they were a young and impressionable teenager who made a stupid mistake. We believe that individuals who have served their time and want to make a change for the better should be able to in an efficient and effective manner. Now, the New Jersey law makers agree. New Jersey Governor, Chris Christie, has signed into law a measure that will make previously ineligible convictions expungeable immediately! The new bill, A206, signed into law on January 19, 2016, has reduced the wait period to apply for an expungement tremendously.
One specific modification amended the wait period for an indictable offense from 10 years to 5 years. This means if you were convicted of an indictable offense you previously would have to wait 10 years from the date of the conviction, payment of a fine, successful completion of probation or release from prison, whichever is later before you could apply for an expungement. With this new law in effect, the wait period has been cut in HALF to just 5 years.
What Does This Mean for You?You may be eligible for an expungement NOW! For example, prior to this new law, if you have a conviction for an indictable offense from 7 years ago you would have had to wait 3 more years to be eligible for an expungement. However, you can now petition for an expungement IMMEDIATELY! If you have a criminal conviction from 2011 you may have known that you could not apply for an expungement before 2021. Now that has changed and you may be eligible for an expungement TODAY.
Similarly, if you were convicted of a disorderly persons or petty disorderly persons offense in the past, the waiting period before you could apply for an expungement was 5 years. This has now been drastically reduced to 3 years. In perspective, if you have a disorderly or petty disorderly persons conviction from 2013 you would not have been eligible for an expungement until 2018.
