Biden Family Unity Parole in Place Program Update

UPDATE:

For those receiving this email you should have recently received a prior email about the PIP Policy. We now have a lot more information about the program and how it will work.

The rule implementing this program will be published sometime on August 19, 2024, it is unclear at what time, but as soon as it is published, the program will be in effect and we will supposedly be able to start filing applications online immediately.

PLEASE NOTE: Even though the program will go live tomorrow, it is very possible that a lawsuit could be filed, as soon as tomorrow or even after that, and this could affect its implementation or even stop it after its starts. This could even mean that you could file an application and then it could be on hold and not be looked at while lawsuits are pending in Court. And, If the Biden administration is found to lack the authority to implement this program, all applications will not be decided and you would lose both your attorney fee if the application is already filed, and potentially your filing fee to Immigration as well. Therefore, if you retain us to file, you are taking a bit of a risk if a lawsuit is filed and the program is halted. You have been warned.

Stepchildren: If you have children under 21 years of age that also entered without inspection, they are also eligible for this program and require their own application. If we are doing stepchildren in addition to the primary parent beneficiary, then there will be a discount for the additional application for the Stepchildren. Stepchildren do NOT have to prove they were physically present in the United States since June 2014. They need only have been present in the United States since June 2024!

If you wish to go forward, here is some important information on what we will need from you to get your case started.

1. Please email your initial questions. We will also have additional staff added on to help us prepare and file applications as quickly as possible. The call volume will be high so we want to able to address the applications quickly. You can email tpaltpalumbo@lslawyers.com
2. The Attorney legal fee to prepare and file the online application will be $2,500. Although I suggested it might be less than that, after seeing what we have to do and how much work it is, I have adjusted the amount to reflect the additional work that will be required to get these properly and promptly filed with USCIS.
3. Therefore to initiate a case, you will have to do two things: Pay the legal fee by credit card in the amount of $2,500 using the following link: https://secure.lawpay.com/pages/lubiner-and-schmidt-llc/operating and in the reference tab please place your name and words "Biden PIP". We will then know the payment is for the PIP program and we will initiate a file for your case in our office right away.
4. Secondly, you will need to provide us with an email with all of your evidence. Upon payment, you will receive an email from the office which will ask you to acknowledge that you initiated a case and what to expect and with the acceptance of our help to file. You will also receive a list of all information and documentation we will need, which you will also have to email to the office. All documents, when possible should be in one or two emails and not in multiple emails. If you send one document at a time, this will slow down the process and your case will go behind those who were able to send documents in a more organized fashion.
5. In order to file an application with USCIS and be able to track its progress, it is strongly recommended, if you do not already have one, to create a USCIS account online with myuscis.gov Once you have your account information, you should email that to us so we can add that to your application. This way, you will get automatically notified when your application is accepted with USCIS.
6. When we are ready to file your application, a member of our office staff will contact you to get your credit card information in order to pay the filing fee online. We have been informed that the filing fee for the form which is Form I-131F, will be $580.
7. Keep in mind that we will be sending you specific instructions once our fee is paid on what documents and information we need, but again, you will need to demonstrate physical presence since June 2014 to the present time, which means documents you were living in the USA for every year since 2014 June. This will be a lot of documents, so please try only to submit documents that are clear and demonstrate your presence here. Try to limit yourself to no more than 5 documents per year and document should be no more than one or two pages each. Everything must be sent through email. We will not be accepting hard copies of documents at this time.
8. PLEASE BE PATIENT. A lot of people will be trying to file applications right away, and we will do our best to file each one as soon as we can, but we cannot file them all at once due to the number of people who likely will be looking to file. Get your documents together, send us your fee and fill out your information promptly and we will prepare and file your case in the order in which everything is received. For updates on your case, please wait until at least Thursday and then use email and include in the subject line "BIDEN PIP" if you are sending any email about the program including your document submissions and of course your full name. ( of the applicant).
9. If for any reason you wish to pay us in cash for this process, we will start accepting cash payments no sooner than Wednesday of this week. Please email us for a time to stop by and drop off payments only.
