The Municipal Courts in New Jersey have jurisdiction over all Title 39 motor vehicle violations and all Title 2C disorderly persons offenses. Common traffic offenses heard in the municipal court are speeding (NJSA 39:4-98), Careless Driving (NJSA 39:4-97), Driving While Suspended or Revoked (NJSA 39:3-40) and Driving While Intoxicated or DWI in violation of NJSA 39:4-50. Other common traffic offenses like Reckless Driving (NJSA 39:4-96), Leaving the Scene of an Accident (39:4-129) and Driving without Insurance (39:6B-2).
All traffic offenses carry potentially serious penalties. Heavy fines, loss of license, insurance premium surcharges and motor vehicle points are common. In some instances, county jail time can be imposed. There are many defenses to most traffic tickets, but not every attorney is up to speed on the status of the law and procedure as it relates to municipal practice.
Likewise, a conviction for a disorderly persons offense such as harassment (NJSA 2C:33-4), disorderly conduct, shoplifting, simple assault, possession of marijuana and paraphernalia etc., can result in a criminal record, loss of license, fines and jail time. The maximum penalty for a disorderly persons conviction is $1000 and a 6 month jail time. As stated, your license can be suspended, especially with drug related convictions.
The New Jersey Municipal Court system is somewhat disjointed. This is because almost every town and city in New Jersey has its own municipal court. Unfortunately, there is very little uniformity in the administration of these courts. The prosecutor’s are different in each court and the judges are as well.
